April 6 - Initial Notes
Daniel will likely get credit for the 23 months he has already served.
So, if Daniel is sentenced to 24 months, he would only serve one more month.
If he is sentenced to 47 months, he would serve another 2 years.
Sentencing is essentially a points system.
There’s a federal guideline system where you start with a base score for the crime, then add or subtract points depending on specific facts, like how serious it was, how many times it happened, and things like that. Then, you factor in the person’s prior record and other variables. Once you have those numbers, you look them up on a chart, and it gives you a sentencing range in months. The sentencing chart for a scenario like Daniel’s is below.
What the prosecution would argue for a higher sentence:
This was repeated, escalating threats. There are 100+ documented threats, and this was a pattern of behavior, not one-off situations.
There were real-world consequences like the DDRC incident.
Daniel ignored numerous FBI warnings, and he continued making threats anyway.
Danger to the public due to the scale of threats and targets.
Daniel is now competent, understands the consequences, etc.
What the defense would argue for a lower sentence:
Daniel is severely mentally ill. Autism, schizophrenia, delusions, and borderline cognition, which resulted in impaired judgment and ability to think rationally.
Daniel has repeatedly been found to be not competent; this is someone barely able to function.
Daniel didn’t have any explosives or weapons and had no ability to carry out threats.
Daniel was being manipulated and egged on by trolls.
Daniel was homeless and didn’t have any support or stability.
